The rules for using the site and the services we provide by electronic means, under Polish law.

01Subject matter and definitions

This document is the regulation governing the provision of services by electronic means under Article 8 of the Polish Act of 18 July 2002 on providing services by electronic means (ustawa o świadczeniu usług drogą elektroniczną). It sets out the rules for using the site www.everest-entprise.com.

03What this site offers

The site is an information tool about our business. Through it we provide, free of charge, only two electronic services:

  1. Access to the content. Reading the pages requires no registration and no account.
  2. Contact form. When you fill it in, your mail program opens with a message already written, which you send from your own address. It exists so that an enquiry reaches us.

We do not sell products or services on the site: no orders are placed, no distance contracts are concluded and no payments are made.

Important

The content published on the site — product descriptions, technical characteristics, references to completed work — is informative and does not constitute an offer within the meaning of Article 66 § 1 of the Polish Civil Code, but an invitation to treat under Article 71. Every supply is governed by the contract or written offer agreed separately.

04Technical requirements

To use the site you need:

  • a device with internet access;
  • an up-to-date browser (Chrome, Safari, Firefox or Edge, within the last two versions) with JavaScript enabled;
  • for the contact form, a configured mail program or an active email address.

Some parts of the site use real-time 3D graphics (WebGL): on older devices or with hardware acceleration disabled they may be slower or may not display. The rest of the content remains accessible.

Using the internet carries known risks — malware, unauthorised access attempts, interception of data. We recommend keeping your operating system and browser up to date and using antivirus software.

05Rules of use

By using the site you undertake to comply with the law and with good practice. In particular, you must not:

  • supply unlawful content, within the meaning of Article 8(3)(2)(b) of the Act on providing services by electronic means;
  • send offensive or defamatory content, or content that infringes the rights of others;
  • use the site to send unsolicited commercial messages (spam);
  • interfere with the operation of the site, attempt to reach non-public areas or circumvent its security measures;
  • extract the site’s content systematically and by automated means in order to reuse it.

In the event of a breach we may restrict or block access to the site, without prejudice to the other remedies available under the law.

06Start and end of the contract

The contract for the browsing service is concluded when you open a page of the site and ends when you close it: it requires no declaration and carries no cost.

The contract relating to the contact form is concluded when you start filling it in and ends when you send the message or leave the page. You can end it at any time by closing the site.

Since neither service involves registration or payment, there is no subscription to cancel and no account to close.

07Intellectual property

The site, its structure, texts, photographs, technical drawings, 3D models, graphics, logos and product names (including Resin Shield, PrimeLab 2.0, Grivex and HydroShield X) belong to Everest Enterprise Solutions sp. z o.o. or to their respective owners and are protected by the Polish Copyright Act of 4 February 1994 and by industrial property law.

You may consult and print the content for personal use or for use inside your organisation. Any other use — copying, distribution, modification, publication, commercial use or inclusion in artificial intelligence systems for training purposes — requires our written consent.

Any third-party trademarks mentioned belong to their respective owners and are used for descriptive purposes only.

08Liability

We take care over the accuracy of the content, but the technical information published is general: values, performance and configurations vary with the vessel, the installation and the operating conditions. Before any technical or commercial decision, ask us to verify the specific case.

We reserve the right to modify, suspend or discontinue the content and functions of the site at any time, including for maintenance.

To the extent permitted by law, we are not liable for damage arising from the inability to access the site, from technical interruptions or from use of the content contrary to these terms. This limitation does not apply to consumers or to entrepreneurs acting as consumers, nor to wilful misconduct or personal injury, and it does not affect liability that Polish law declares to be mandatory.

09Complaints

If the site does not work as it should, or if you have objections about the electronic services described here, write to us at office@everest-entprise.com or to our registered address.

So that we can act quickly, please state:

  • contact details for our reply;
  • the page or function concerned;
  • a description of the problem, with the date and time it occurred;
  • the device and browser you were using.

We examine the complaint and reply within 14 calendar days of receiving it, to the address you gave us.

10Consumers and dispute resolution

If you use the site as a consumer within the meaning of Article 22¹ of the Polish Civil Code, or as an entrepreneur acting for purposes outside your professional activity, you keep every right the law gives you: no clause of these terms can limit them.

Besides the courts, you may use out-of-court means of resolution: the provincial inspectorate of the Trade Inspection (Wojewódzki Inspektorat Inspekcji Handlowej), the municipal or district consumer ombudsman (miejski lub powiatowy rzecznik konsumentów) and the information published by the Office of Competition and Consumer Protection at uokik.gov.pl.

Please note that the site does not allow online purchases: no distance contracts are concluded here, so the 14-day right of withdrawal provided for consumer sales does not apply.

11Personal data

The processing of personal data is described in the privacy notice, which forms an integral part of these terms.

12Changes to these terms

We may amend these terms for technical, organisational or legal reasons. The version in force is always the one published on this page, with the update date shown at the top; it applies to sessions after publication.

You can download or print these terms at any time directly from this page.

13Governing law and jurisdiction

These terms and the use of the site are governed by Polish law. On matters not covered here, the Polish Civil Code, the Act on providing services by electronic means, the Copyright Act and other applicable rules apply, including those of the European Union.

For disputes with parties who are not consumers, the court with jurisdiction is the one for our registered office. For consumers and for entrepreneurs acting as consumers, the statutory rules on jurisdiction continue to apply.

This document is available in Italian, English, Polish and German. In case of discrepancy, the Polish version prevails for matters governed by Polish law.
